Banta praises Supreme Court’s decision limiting government agency authority

Rep. Jake Banta (R-Erie) expressed approval for the U.S. Supreme Court’s decision in Loper Bright Enterprises v. Raimodo, which overturned the 1984 Chevron v. National Resources Defense Council ruling.

The court reversed a longstanding precedent that permitted federal agencies to define their own authority. The Chevron Doctrine had enabled unelected federal bureaucrats to exert significant power in crafting regulations affecting various aspects of American life, including the workplace and healthcare.

“The overturning of the Chevron Doctrine represents a new day in preventing government overreach in our nation,” Banta stated. “Chevron led to an oversized federal government ruled by bureaucrats, not elected officials. This decision makes it clear our governments, both federal and state, must be for and by the people.”

Earlier this year, Banta introduced legislation aimed at curbing regulatory overreach within Pennsylvania’s administrative agencies, mirroring concerns that led to the reversal of the Chevron decision.

House Bill 2298 seeks to prevent Pennsylvania’s executive agencies from reinterpreting statutes enacted by the General Assembly and aims to restore a proper separation of powers between legislative and executive branches. The bill is viewed as a significant measure to limit government oversight and overregulation.

House Bill 2298 has been referred to the House State Government Committee for review.
